Terms of Service

These terms govern your use of the website at average5.com and the engagement you may enter with Average 5 Digital Marketing (AVER5GE Studio), Sheikh Zayed City, Giza, Egypt.

1 · Use of this site

This site is a marketing site. The information here is provided as-is, with no warranty. We update it often. You can use it freely for personal and commercial reference. You may not scrape, mirror, or resell the content.

2 · Engagements

If we begin an engagement together, the binding terms are in the signed Statement of Work (SOW), not on this site. The SOW always wins. This page sets the baseline.

• Payment. Sprint engagements: 50% on signing, 50% on delivery. Retainers: monthly in advance. Partnerships: as defined in the SOW.
• Cancellation. Retainers require 30 days written notice. Sprints are non-refundable once kickoff has happened. Partnerships follow the SOW.
• IP transfer. All deliverables transfer to the client on full payment. We retain the right to display the work in our portfolio unless explicitly NDA'd.
• Source files. Always included. Always delivered on completion.

3 · What we won't do

• We will not work on projects that promote hate, fraud, or harm.
• We will not white-label our work without an explicit agreement and a premium.
• We will not chase invoices past 45 days — overdue accounts pause work until cleared.

4 · Liability

Our liability is limited to fees paid in the 6 months preceding any claim. We are not responsible for lost profits, lost data, or consequential damages.

5 · Confidentiality

Everything you share with us is treated as confidential by default. NDAs are signed on request, at no charge, before any commercial discussion.

6 · Jurisdiction

These terms are governed by the laws of the Arab Republic of Egypt. Disputes go to the courts of Giza, Egypt, unless both parties agree to arbitration.

7 · Changes

We may update these terms occasionally. Material changes will be announced on the homepage for 14 days before taking effect. Continued use of the site after that means acceptance.
